During the recent AMA Interim Meeting in Orlando, I saw AMA staffers who were crying over the presidential election results, and AMA delegates who were nervously fretting over the implications of RFK Jr being proposed as the head of the Department of Health and Human Services. If you are upset over the election, you can take solace by knowing that MSSNY is a bipartisan organization that continues to advocate for patient safety, no matter which party is in power. Furthermore, one of your MSSNY benefits is our Peer-to-Peer program.

The pillars of the P2P program are Support, Empathy, and Perspective.

Physicians, residents, and medical students have enormous stressors that can range from the emotions that arise in the context of patient care to the demanding environment in which we practice medicine. MSSNY’s Committee on Physician Wellness and Resiliency played an integral role in the creation of the P2P program—which grew out of a MSSNY survey that found over 50 percent of New York physicians suffer from life stressors.

Physicians are healers that too often are reluctant to seek help for themselves. We hope that colleagues will connect to peer supporters to discuss daily stressors, including work, school, family, substance, or financial issues. And if one of those stressors is the recent election results, the P2P Program is here for that, too.

If someone you know is struggling with life stressors, reach out to the P2P program to connect them to a peer supporter. Email [email protected] or call 1-844-P2P-PEER (1-844-727-7337) and request that you be connected with a peer supporter. In addition to offering a trained, empathetic ear, peer supporters may provide information on specific resources that can offer further support, provide positive coping skills, or connect physicians to professionals for more focused assistance.

Fix Medicare Now: Tell Your Representative to Co-Sponsor H.R. 10073

MSSNY and the American Medical Association continue to be deeply alarmed about the growing financial instability of the Medicare physician payment system due to a confluence of fiscal uncertainties physician practices face related to the Change Healthcare cyberattack, statutory payment cuts, lack of inflationary updates, and significant administrative barriers. The payment system remains on an unsustainable path threatening beneficiaries’ access to physicians.

Therefore, it is urgent that Congress pass legislation (HR 10073) before year end to replace pending Medicare cuts for 2025 with increases, and work with the physician community to develop long-term solutions to the systematic problems with the Medicare physician payment system and preserve patient access.

Congress needs to establish a permanent, annual inflationary Medicare physician payment update that keeps up with the cost of practicing medicine and encourages practice innovation. They also need to eliminate or completely overhaul the overly burdensome Medicare Merit-based Incentive Payment System (MIPS).

Tell your Representative to cosponsor the Medicare Patient Access and Practice Stabilization Act (H.R. 10073)!

Time is running out! There are precious few legislative days left before the end of the year with Congress expected to conduct a “lame duck” session now that the elections are over. This will be the last opportunity for Congress to pass H.R. 10073 as part of the final year-end package.

That’s why it is so important that you contact your Representative and urge them to cosponsor “The Medicare Patient Access and Practice Stabilization Act (H.R. 10073) today!

While this legislation would only address physician payment for 2025, it is a crucial first step in providing much needed relief and achieving our ultimate goal of complete physician Medicare payment reform in the new Congress.

Everyone agrees the Medicare physician payment system is broken, and it’s time for Congress to do something about it!

New Child Abuse Course Requirements: Implicit Bias, ACEs, and Virtual Interaction Protocols Due by April 2025

There are now additional requirements for the Child Abuse course that include protocols to reduce implicit bias in decision-making processes, strategies for identifying adverse childhood experiences, and guidelines to assist in recognizing signs of abuse or maltreatment while interacting virtually within the New York State Mandated Identification and Reporting of Child Abuse and Maltreatment/Neglect coursework.  This coursework must be completed by April 2025.

The State Education Department has a list of SED-accredited providers. MSSNY recommends that physicians take the approved training curriculum by the April 1, 2025 deadline:  OP:Training: Mandated Training Related to Child Abuse.

The law exempts from the training an individual who can document, to the satisfaction of the Department, that there is no need for the training based on the nature of his or her practice. You may be eligible for an exemption if the nature of your practice is such that you do not have professional contact with persons under the age of 18 years.  An exemption form must be filed with the SED (the form can be found on the SED website: OP:Training: Mandated Training Related to Child Abuse.)

Attorney General James Sues UnitedHealth and Amedisys to Stop Merger

New York’s Attorney General Letitia James has joined three state attorneys general and the U.S. Department of Justice (DOJ) in a lawsuit against two of the country’s largest providers of home health and hospice services for seniors, UnitedHealth and Amedisys, to block United’s acquisition of Amedisys which will threaten the quality of critical health care services for millions of Americans, including New Yorkers.

As noted in the AG’s press release, United and Amedisys are top competitors in many home health markets across the country, including certain areas of upstate New York. The competition forces both companies to improve the quality of their services, keep costs low, and incentivizes them to offer higher pay and benefits to their employees. The lawsuit maintains that United’s acquisition of Amedisys would violate antitrust laws by ending competition, leaving vulnerable patients and their families with worse care, higher prices, and result in lower pay and benefits for healthcare providers.

The release further highlights the concern of this excess market concentration in the context of millions of seniors across New York relying on home health and hospice services every day to stay in their homes as they receive essential medical and end-of-life care. As demand for home health and hospice rises as the U.S. population ages, these services are becoming increasingly valuable and essential for millions of American families.
