Information on Extreme Risk Protection Orders (ERPO)

During the 2024 MSSNY House of Delegates, a resolution was passed calling upon MSSNY to raise awareness of the Extreme Risk Protection Orders (ERPO) process amongst physicians and to provide linkage to the various websites available through the New York State court system. In New York, ERPO is a civil court-issued order that temporarily prohibits individuals who pose a danger of injury to themselves or others from purchasing and/or possessing firearms, rifles, or shotguns if a family or household members, district attorney, law enforcement officer, or school administrator petitions a court. In New York State, Section 9.46 of the Mental Hygiene law requires physicians and other mental health providers currently providing treatment services to an individual to make a report if they conclude, using reasonable professional judgment, that the individual is likely to engage in conduct that would result in serious harm to self or others.

MSSNY Policy 260.974 Providing Information on Extreme Risk Protection Orders (ERPO) requires that MSSNY provide information on how the ERPO process works through its communication vehicles, including newsletters, social media and the MSSNY website.
