Physicians and patients need the NYS Legislature to complete their task of passing legislation to control medical liability premiums. Legislators must realize that holding off from announcing the new rates delays the crisis but doesn’t solve the underlying problem.
Every New York physician and every patient should reach out to their NYS legislators and strongly urge them complete the work they have begun on reforming the medical liability system.

STATE ANNOUNCES DELAY IN NEW MEDICAL
MALPRACTICE RATES
New York State Insurance Superintendent Eric Dinallo announced today that he is delaying the setting of new medical malpractice insurance rates past July 1, 2008 to allow time for the negotiation of reforms that have the potential to result in reduced rates. When rates for 2008-2009 are determined, they will be retroactive to July 1, 2008.
CMS ANNOUNCES HOLD ON PROCESSING OF MEDICARE CUTS TO PERMIT CONGRESS TO ADDRESS ISSUE
The Center for Medicare and Medicare Services (CMS) has announced that they will temporarily refrain from processing physician Medicare claims for care rendered starting July 1 so as to give Congress an opportunity to address the 10.6% Medicare physician reimbursement cut after Congress returns from its July 4 recess. As previously noted, the cut is required to go into effect beginning July 1 because the United State Senate failed to pass legislation prior to the recess to prevent the imposition of the cut. MSSNY and the AMA issued press releases Friday condemning the actions of several Republican Senators who scuttled the enactment of legislation which had passed the House to prevent the cut.
While legislation to address the cut has been strongly supported by the New York Congressional delegation, including Senators Schumer and Clinton, physicians must continue to put pressure on them to address this issue immediately when they return to Washington July 7. COMMENTS OF MICHAEL ROSENBERG, MD, URGING ACTION IN SUPPORT OF MEDICAL LIABILITY REFORM
“With just 5 days remaining before the Superintendent of Insurance is set to impose another exorbitant increase in the already unaffordable cost of medical liability insurance, physicians across New York State are urging the State Legislature to return to Albany to take action to prevent a health care access disaster.
This situation facing New York’s physicians is dire. They are caught in an ever tightening squeeze between rapidly rising overhead costs and declining reimbursement. New York physicians are currently struggling with the 14% malpractice insurance increase that was imposed last July, as well as the cumulative 55-80% rise in premium costs over the last five years. At the same time, physicians face ongoing efforts by private and public health insurers to constrain reimbursement, including a draconian 10.6% cut to their Medicare reimbursement, set to be implemented July 1 unless Congress takes action in the next 72 hours to prevent the cut.
Yet despite these problems the Legislature left Albany without taking any action whatsoever to avert the impending disaster. For many physicians, the increase expected to be promulgated next week will be unaffordable and consequently, they simply will be unable to practice.
We urge the Governor to reactivate discussions on medical liability reform immediately, and that the Legislature return to Albany to enact legislation to address this crisis before patient access to care is irreparably harmed.”
